1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you ("you" or "user") and TrueMoments ("we", "us", or "our") governing your access to and use of the TrueMoments website at truemoments.io and our AI photo animation service (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

The Service is not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or similar laws. If your use of the Service is governed by such regulations, you may not use the Service.

You must be at least 18 years of age to use this Service. By using TrueMoments, you represent and warrant that you are 18 years old or older.

2. Intellectual Property Rights

Unless otherwise stated, TrueMoments owns all intellectual property rights in and to the Service, including but not limited to the website, source code, software, designs, graphics, text, logos, trademarks, and all other content ("our Content"). All rights are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes only. This licence does not include the right to:

• Copy, reproduce, distribute, or republish any portion of our Content without our prior written consent.
• Modify, translate, adapt, or create derivative works based on our Content.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or its underlying AI technology.
• Use any data mining, scraping, robots, or similar automated data collection methods on the Service.
• Remove or alter any proprietary notices, labels, or marks on the Service.

Any unauthorised use of our Content or intellectual property terminates the licence granted herein and may violate applicable copyright, trademark, and other laws.

3. User Representations

By using TrueMoments, you represent and warrant that:

• All registration information you provide is true, accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update it as necessary.
• You have the legal capacity to enter into these Terms and to comply with them.
• You are not a minor in the jurisdiction in which you reside — you are at least 18 years old.
• You will not access the Service through automated or non-human means, including bots, scripts, or other automated software.
• You will not use the Service for any illegal or unauthorised purpose.
• Your use of the Service will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse all current or future use of the Service.

4. User Registration

You must register for an account to access the full features of TrueMoments. You may register using an email address and password, or by authenticating through Google OAuth. When you register using Google, we receive your name and email address from Google as described in our Privacy Policy.

You are responsible for keeping your password and account credentials confidential. You agree not to share your account credentials with any third party and to take all reasonable steps to prevent unauthorised access to your account.

You accept full responsibility for all activities that occur under your account, whether or not you authorised them. You agree to notify us immediately at support@truemoments.io if you discover or suspect any unauthorised use of or access to your account.

5. Fees and Payment

TrueMoments accepts payments via Stripe, supporting major credit and debit cards including Visa, Mastercard, American Express, and Discover. All prices are displayed in United States Dollars (USD). Applicable sales tax may be added to your purchase depending on your location.

Pricing tiers: We offer three plans — Basic, Pro, and Premium — available in three billing formats:

One-time credit packs: Purchase a set number of credits in a single transaction. One-time credits never expire and remain in your account until used, regardless of how long that takes.
Monthly subscriptions: A recurring monthly charge that allocates a defined number of credits at the start of each billing period.
Yearly subscriptions: A single annual charge that allocates credits at the start of the billing year, typically at a discounted rate compared to monthly.

Subscription credits reset monthly. Credits allocated through a subscription plan reset at the beginning of each billing period. Unused subscription credits do not roll over to the next period and are forfeited upon reset.

Subscriptions renew automatically at the end of each billing period unless you cancel in advance. By purchasing a subscription, you authorise TrueMoments to charge the applicable fee to your payment method on a recurring basis until you cancel.

We reserve the right to correct any pricing errors and to change our prices at any time. Price changes to active subscriptions will be communicated in advance, and your continued use of the subscription after the effective date constitutes acceptance of the new price.

6. Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting us at support@truemoments.io.

Cancellation takes effect at the end of your current billing period. Following cancellation, your subscription will not renew, and you will not be charged again. You will retain access to the Service and any remaining credits in your account until the current billing period expires.

TrueMoments does not offer a free trial period. All purchases, whether one-time credit packs or subscription plans, are subject to our Refund Policy below.

7. Refund Policy

Each animation generated through TrueMoments incurs a real cost to us for AI processing. Our refund policy reflects this while remaining fair to users.

One-time credit purchases:

Full refund within 7 days if no credits from the purchase have been used. Contact us within 7 days of purchase with your account email and purchase date.
Prorated refund for partially used credit packs may be issued at our discretion based on the number of remaining unused credits.
No refund is available more than 7 days after purchase or once all credits have been used.

Monthly subscriptions: Refund requests are considered case-by-case within 7 days of the most recent charge. Contact us at support@truemoments.io with your reason for requesting a refund.

Yearly subscriptions: A prorated refund may be issued within 30 days of purchase if fewer than half of the annual credit allocation has been used. Refund requests after 30 days, or once more than half of the annual credits have been used, will not be accepted.

Credits used to generate animations: We do not issue refunds for credits that have been used to generate animations, unless the output was visibly distorted, failed to generate, or the failure was due to a technical error on our end. Dissatisfaction with the animation style, artistic interpretation, or quality variance inherent to AI-generated content does not qualify for a refund.

Technical failures: If an animation fails to complete due to a technical error on our infrastructure or our AI processing pipeline (and not due to an inappropriate or invalid upload), the credit consumed will be automatically restored to your account.

Content moderation blocks: If your uploaded photo is blocked by our automated NSFW moderation system before any processing begins, no credit is consumed. No refund is required in this scenario.

Non-qualifying reasons: The following do not qualify for a refund under any circumstances:

• Forgetting to cancel a subscription before it renews.
• Dissatisfaction with animation results that vary from personal expectations or stylistic preferences.
• Credits that have been used, regardless of the perceived quality of the output (except in the case of a verified technical failure on our end).

How to request a refund: Email support@truemoments.io with: (1) the email address associated with your account, (2) the date of purchase, and (3) a clear explanation of the reason for your request. We aim to respond within 3 business days. Approved refunds are processed through Stripe and typically appear on your original payment method within 5–10 business days.

Fraudulent claims and chargebacks: We take fraudulent refund claims and unauthorised chargebacks seriously. If you initiate a chargeback without contacting us first, we reserve the right to provide your bank with evidence of service usage, credit consumption records, and any other relevant documentation. Repeated abuse of the refund process, submission of fraudulent claims, or unjustified chargebacks may result in permanent account suspension and, where applicable, legal action.

8. Content Moderation and Acceptable Use

All photos uploaded to TrueMoments are automatically scanned by our content moderation system before processing. Photos flagged as containing explicit, harmful, or prohibited content are rejected and not submitted to our AI pipeline. No credit is consumed for rejected uploads.

You agree that you will not use TrueMoments to:

• Upload, submit, or animate photos containing illegal content, including child sexual abuse material (CSAM) or non-consensual intimate imagery.
• Upload photos of individuals without their consent or in a manner that violates their privacy.
• Generate deepfakes or synthetic media intended to deceive, impersonate, harass, or harm other individuals.
• Attempt to bypass, circumvent, or disable our content moderation or safety systems by any means, including image manipulation or adversarial inputs.
• Use automated tools, bots, or scripts to access the Service in a way that exceeds normal personal use.
• Reverse-engineer, decompile, extract, or attempt to reproduce our AI models, algorithms, or processing pipelines.
• Reproduce or redistribute the Service or its outputs in ways that compete with TrueMoments commercially.
• Upload photos containing viruses, malware, or other malicious code.

Violations of this section may result in immediate account termination without notice and without refund of any remaining credits.

9. Content Ownership and License

You retain full ownership of the photos you upload to TrueMoments. By uploading a photo, you grant TrueMoments a limited, non-exclusive, royalty-free licence to process your photo through our AI animation pipeline solely for the purpose of producing the animation you requested. This licence terminates once your animation has been generated and made available to you.

Your photos are never used to train AI models, sold to third parties, shared publicly, or retained beyond the scope described in our Privacy Policy.

You represent and warrant that you have all necessary rights, permissions, and consents to upload the photos you submit to the Service and to use them in the manner described in these Terms. You are solely responsible for ensuring that your uploads do not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

Generated animations are owned by you, subject to any restrictions in these Terms and the rights of any third parties depicted in or whose intellectual property appears in the source photo.

TrueMoments is not responsible for any content you upload, including for any infringement of third-party rights caused by your uploads. You agree to indemnify and hold TrueMoments harmless from any claims arising from your uploaded content.

10. Privacy Policy

Your use of TrueMoments is also subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your personal information as described in our Privacy Policy. Please read it carefully.

The TrueMoments Service is hosted and operated in the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. By using the Service, you consent to this transfer.

11. Prohibited Activities

In addition to the content restrictions in Section 8, you may not engage in any of the following activities when using TrueMoments:

• Systematically retrieve data or content from the Service to create or compile a database, directory, or collection without our written permission.
• Trick, defraud, or mislead TrueMoments or other users, including attempting to obtain sensitive account information by deception.
• Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict use or copying of content.
• Upload or transmit viruses, Trojan horses, or any other material that interferes with any party's uninterrupted use and enjoyment of the Service.
• Use any automated tool (bots, spiders, scrapers) to access the Service in a volume or manner inconsistent with normal personal use.
• Impersonate another user or person, or use the username of another user without permission.
• Interfere with, disrupt, or create an undue burden on the Service or the networks connected to it.
• Use the Service as part of any effort to compete with TrueMoments or to build a similar or competing product or service.
• Sell, transfer, or assign your account or any account rights to another person.
• Use the Service to generate content for illegal purposes, including fraud, defamation, or harassment.
• Attempt to extract, copy, or reproduce TrueMoments' AI models or proprietary algorithms through interaction with the Service.

12. Site Management

TrueMoments reserves the right, but not the obligation, to: monitor the Service for violations of these Terms; take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms; refuse, restrict, limit, or disable access to the Service; remove, edit, or block content at our sole discretion; and otherwise manage the Service in a manner designed to protect our rights and property and to facilitate the proper functioning of the Service.

13. Term and Termination

These Terms remain in full force and effect while you use the Service. We reserve the right to deny access to and use of the Service (including blocking certain IP addresses) to any person, at our sole discretion, for any reason or no reason, without notice or liability.

We may terminate your account or suspend your access to the Service at any time and without prior notice if you breach any provision of these Terms, if we reasonably suspect fraudulent activity, or if your conduct may harm TrueMoments, other users, or third parties.

If your account is terminated for a violation of these Terms, you are prohibited from creating a new account under your name, a fake or borrowed name, or the name of any third party. In addition to terminating your account, we reserve the right to take appropriate legal action, including civil, criminal, or injunctive relief.

14. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Service at any time and for any reason, without notice. We also reserve the right to modify or discontinue the Service, in whole or in part, at any time without notice.

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the Service. We do not guarantee that the Service will be available at all times and we are not obligated to maintain or update it. We will not be liable for any losses or damages caused by the Service being unavailable.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

16. Dispute Resolution

Informal resolution: Before initiating formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@truemoments.io. Both parties agree to make good-faith efforts to resolve the dispute within 30 days of initial notice.

Binding arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Arbitration shall take place in New Jersey. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

No class actions: You agree that any arbitration shall be conducted in your individual capacity only, and not as a class action or other representative proceeding. You expressly waive any right to bring or participate in a class action lawsuit or class-wide arbitration.

Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm. Disputes related to intellectual property rights are excluded from mandatory arbitration.

Limitation period: Any claim or cause of action arising from or relating to your use of the Service or these Terms must be brought within one (1) year after such claim arose, or it will be permanently barred.

17. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEMOMENTS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that the Service will meet your requirements, operate without interruption, be error-free, or that any defects will be corrected. We make no guarantees regarding the quality, accuracy, or artistic output of AI-generated animations. AI-generated content is inherently variable and results may differ from your expectations.

We are not responsible for any loss or damage arising from your use of third-party services integrated with TrueMoments, including Stripe, fal.ai, Supabase, Vercel, or Google OAuth. Their respective terms and privacy policies govern your use of those services.

18. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUEMOMENTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO TRUEMOMENTS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless TrueMoments and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of or access to the Service;
• Your breach of these Terms or any representation or warranty made herein;
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights;
• Any content you upload, submit, or transmit through the Service;
• Any harmful, negligent, or wrongful act or omission on your part in connection with the Service.

20. User Data

We maintain certain data that you transmit to the Service for the purpose of operating the Service, managing your account, and providing animations. You are responsible for all data you transmit, including ensuring it does not violate any applicable laws or third-party rights.

Although we perform routine data backups, you agree that we shall have no liability for the loss, corruption, or destruction of any data. You are solely responsible for maintaining independent copies of any content you consider important.

21. Electronic Communications

By using the Service, you consent to receiving electronic communications from TrueMoments. These communications may include notices, agreements, disclosures, and other information. You agree that all communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

You also agree that electronic signatures, contracts, orders, and other records created in connection with your use of the Service are valid and enforceable to the same extent as their paper equivalents.

22. Miscellaneous

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TrueMoments with respect to your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

TrueMoments may assign its rights and obligations under these Terms at any time without notice to you, including in the event of a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our prior written consent.

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and TrueMoments. These Terms are for the sole benefit of the parties hereto and do not confer any rights on any third party.
